Transitioning from H-1B to EB-1C or EB-2 NIW for Enterprise Architects
Two very different arguments: one about organizational authority, the other about the national importance of the work itself.
Where EB-1C fits
The multinational manager or executive category suits architects who have moved into genuine organizational leadership — directing a function, managing professional staff or an essential function, and exercising discretionary authority. It requires a qualifying relationship between a foreign entity and the petitioning employer, and at least one year of qualifying employment abroad within the relevant window.
The evidentiary center of gravity is organizational: charts showing subordinate professionals, budget authority, hiring and evaluation responsibility, and decisions the architect made without escalation. Purely technical seniority, however impressive, does not by itself establish managerial capacity, and function-manager arguments require showing the function is essential and that the architect operates at a senior level within the hierarchy.
Where EB-2 NIW fits
The national interest waiver removes the labor certification requirement when the endeavor has substantial merit and national importance, the individual is well positioned to advance it, and waiving the job offer benefits the country. For architects, the persuasive framing is usually the endeavor itself — critical infrastructure modernization, healthcare data interoperability, financial systems resilience, or cybersecurity capability at national scale.
Evidence runs to impact rather than hierarchy: adoption of frameworks the architect authored, measurable outcomes from consolidation or security programs, published work, standards participation, conference presentations, and independent letters from people who used the architect's work rather than merely supervised them.
Sequencing and practical timing
Category choice should be made early enough to shape the record. An architect on a managerial track should accumulate documented supervisory authority; one pursuing a waiver should be building a public record of contribution. Both paths benefit from consistent role documentation across the H-1B history, because inconsistencies between petitions attract questions.
Consider filing strategy as well as merits: priority date movement, concurrent adjustment eligibility, and the ability to maintain status through extensions all influence which path is genuinely faster in practice. The strongest case is rarely the one assembled in a hurry near the end of a status window.
